Rationale

The statutory instrument will be reviewed to assess its effectiveness and ensure it remains relevant and aligned with evolving legislation, policy objectives, and priorities. A periodic review of this regulation can therefore be completed to ensure that it is updated and amended accordingly.

Narrative

The Export Development Canada (EDC) Legislative Review is part of the statutory obligation under the EDA. As required by the act, every 10 years the Minister initiates a review of the provisions and operation of the Act to be undertaken, in consultation with the Minister of Finance. The Minister shall submit a report on the review to Parliament within a year, and Parliament then studies the report and the EDA.

EDC’s legislation is supplemented with regulations that define in more detail how its legislative powers are to be used. The regulations were reviewed twice in the last five (5) years, first during the 2018 Legislative Review and subsequently during the COVID-19 pandemic.

The regulations don’t expire, and a future review will be conducted as part of the forthcoming decennial review of the EDA in 2028.
