Rationale
This regulation is being reviewed to ensure it accurately implements the applicable UNSC resolutions and to ensure consistency between Canada’s UNA regulations.
Narrative
As a Member State of the United Nations (UN), and pursuant to article 25 of the Charter of the United Nations, Canada is legally obligated to implement binding decisions of the United Nations Security Council (UNSC) taken under Chapter VII. The UNSC passes resolutions, developed by specific Committees, to impose UN sanctions measures. Global Affairs Canada coordinates with the Department of Justice to implement these resolutions into domestic law through the development of regulations under the UNA.
This instrument could be amended to add or correct references to UNSC resolutions and to implement recent changes. In particular, the regulations should reflect the latest decisions of the UNSC, including resolutions 2699 (2023) and 2700 (2023), which have modified the scope of the arms embargo on Haiti. Similarly, the regulations may be reviewed on a responsive basis to make miscellaneous or administrative amendments addressing recommendations by the Standing Joint Committee on the Scrutiny of Regulations, including to ensure consistency and coherence between its various UNA regulations. One such example is the definition of “armed mercenary,” which will be an area of review for this regulation.
