Rationale
These regulations are being reviewed to ensure they are fit-for-purpose and in line with Canada's foreign policy objectives in relation to the socio-political context in Haiti.
Narrative
These regulations have been reviewed and amended at least 11 times since their entry into force. Considering the ongoing social and political context in Haiti and Canada’s support to the Haitian government, updates or amendments could be made to better align with the legislation’s objective of combating instability, impunity and corruption caused by malicious actors, including but not limited to gang members. Potential areas for review or amendments include:
- ensuring that not all current or former officials of the Haitian government are automatically subject to Canadian sanctions and emphasize that the focus is on those government officials who have contributed to instability;
- sanctioning individuals who have participated in acts of sexual violence; and
- allowing the use of evidence beyond open-source information.
