Determining whether the privileges and immunities granted for the International Criminal Court must be updated.
Narrative
This Order grants privileges and immunities to the International Criminal Court as a body corporate. This Order is the means by which Canada has implemented its legal obligation as a State Party to the Rome Statute to ensure that the International Criminal Court enjoys, on Canada’s territory, “such privileges and immunities as are necessary for the fulfilment of its purposes” (Article 48). These privileges and immunities are set out in the Agreement on the Privileges and Immunities of the International Criminal Court, which was agreed to by the Assembly of States Parties in 2002. This Agreement remains in force and has not been amended. No changes or amendments to the Order are thus required.
